Performance Income and the Producer

This concern is at the forefront of current Guild activity, particularly
in light of the recent EU Directive which seeks to harmonise European law
regarding neighbouring rights and performance income. Re-Pro is now spearheading a campaign to ensure that audio producers benefit from performance income. It has forged links with other organisations including the IMF and BASCA,
and has - in association with Equity, the Musicians Union, ISM and others
- founded the Performing Artists Media Rights Association (PAMRA).
Re-Pro has gained the support of PAMRA in acknowledging that at least a
part of the producers' role should be regarded as a performance and PAMRA
is expected to argue the producers' case in international forums and performance
royalty collecting organisations.
Performance income and neighbouring rights are international concerns which
have galvanised 'producer' organisations throughout the world. By working
closely with these organisations, Re-Pro will continue its fight to ensure
that members receive their fair share of performance income, both in the
UK and overseas.
Latest Developments
In the UK, the law which will implement the European Rental and Lending Directive is being discussed in Parliament and will be in place by 1st December 1996. After that date all performers will have a new right to received 'equitable remuneration' for uses of their work when broadcast or in public places.
Re-Pro is involved with a number of industry bodies discussing how the new law can be implemented. One of Re-Pro's priorities is to use their relationship with the performer organisations, especially the performers' collection society, PAMRA, to help ensure that performer payments are conducted in an efficient and transparent way.
In addition, Re-Pro is liaising with the record companies and the music publishing collection organisations to help co-ordinate the information gathering which will provide the foundation of all copyright management systems in the future. (see Recordings Register.)
